This Privacy Policy discloses the privacy practices for the www.becauseone.com site and various related services (together referred to as the “site” or “Platform”). becauseOne, LLC d/b/a becauseOne, the provider of the site (referred to as “becauseOne”), is committed to protecting your privacy online. Please read the information below to learn the following regarding your use of this site.

You acknowledge that this Privacy Policy is part of our Site Terms of Use, and by accessing or using our site, you agree to be bound by all of its terms and conditions. If you do not agree to these terms, please do not access or use this site.

We reserve the right to change this Privacy Policy at any time. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to issuing an email to the email address listed by registered users and posting the revised Policy on this page. You acknowledge and agree that it is your responsibility to maintain a valid email address as a registered user, review this site and this Policy periodically and to be aware of any modifications. Your continued use of the site after such modifications will constitute your: (a) acknowledgment of the modified Policy; and (b) agreement to abide and be bound by the modified Policy.

Users of our site include users that are identified on our site as Gifter, Nonprofit Organization, Administrator. Only a nonprofit organization pays a fee to use the site. Administrators include selected becauseOne team members who have access to information provided in user sign up. All references to “you” in this Privacy Policy means any user of the site including, but not limited to Gifters, Nonprofit Organizations and Administrators.

INFORMATION WE COLLECT

In order to better provide you with our numerous services, we collect several types of information about our users: information you provide directly to us and information that is passively or automatically collected.

Our primary goal in collecting information from you is to provide you with a smooth, efficient, and customized experience while using our site.

A. Information That You Provide Directly to Us:

Registration information: When you register as a User or open an account, we collect your email address and login details, your zip code, your phone number, and any optional information you choose to provide us (such as a profile picture, About, interest categories etc). You have the option to add a payment method to save to your account. If you do not provide the mandatory data with respect to a particular activity, you will not be able to engage in that activity.

If you are a charity or nonprofit organization and are established as such under the applicable laws of incorporation (“Charity”), we use our Application Programing Interface (“API”) we will ask that you select your Charity and provide information to verify that you are a representative of said Charity. There is also a manual entry process for nonprofits not found through the API. The same information will be required. During registration you will be required to set up a third party, payment processor account who will also complete their verification process. We will keep a payment method on file for the Room Fees (see Terms of Use). You also have the option to provide further information including but not limited to profile/banner photo, mission statement, interest categories, etc.

Information provided while setting up a Room:

When you set up a nonprofit Room (see Terms of Use) on the Platform, we collect the information you choose to provide us in relation to your organization we display it through our Platform. For example, you can provide a Room Name, choose up to three interest categories for your Room and Needs posted in your Room, upload images and describe your organization and the needs posted. By providing information in your Room, you consent to our collection, storage, and use of your data.

Administrators have access to information provided by users during account set up. This includes but is not limited to: nonprofit name, address, phone number, tax ID, intake questions, Stripe account status, contact name, email address, interest categories. This information is used for administrative purposes including but not limited to: nonprofit verification, data collection, account activation and deactivation, etc. This information is meant for administrative uses only.

If you upload personal data related to any third parties, you acknowledge and agree that you have the authority of the relevant third parties for us to access and use the relevant data and that you have notified the third parties and informed them of how their information is collected and used by becauseOne to provide the Services. You can also provide us with information about yourself or third parties that is considered sensitive, such as political opinions, health information, religious beliefs, etc. If you post this information in a Room, you choose to provide such information to be published publicly in relation to your Room, organization, need or otherwise. We reserve the right to identify you as the person who has made the referral in any messages that are sent to them.

Our payment processors also collect and maintain information related to your withdrawal of funds from any Room.

Information collected while setting up payment transfers:

As a nonprofit, we collect your contact details (such as name and email address), zip code, your phone number (to send you important messages), your EIN and any information you choose to provide us.

We do provide some of our services through contractual arrangements with affiliates, services providers, partners and other third parties. We and our service partners use your Registration Information to operate our site and to deliver their services. For example, we must release your credit card information, or ACH Information to confirm payment for gifts or Rooms made on this site to third party payment processors.

We will encourage our service partners to adopt and post privacy policies. However, the use of your Registration Information by our service partners is governed by the privacy policies of those service partners and is not subject to our control.

Donation information:
On the Platform, when you donate an item or sponsor a Room, we collect your contact details (such as name and email address), zip code, and any information you choose to provide us (such as a description of why you have donated).

We do provide some of our services through contractual arrangements with affiliates, services providers, partners and other third parties. We and our service partners use your Registration Information to operate our site and to deliver their services. For example, we must release your credit card information, or ACH Information to confirm payment for gifts or Rooms made on this site to third party payment processors.

We will encourage our service partners to adopt and post privacy policies. However, the use of your Registration Information by our service partners is governed by the privacy policies of those service partners and is not subject to our control.

Our payment processors hold your credit card details and other information necessary to process the donation (such as your home address).

Public Communications:
You can show appreciation by “liking” activity happening on the Platform and communicate with other users through our Platform. Any content, you choose to share in your activity feeds (including but not limited to: liking activities, making gifts to Rooms, sponsoring rooms, etc) that you choose to post through our Platform or share to another platform are available to the public by default.

Please remember that any information that is disclosed in these areas becomes public information for both us and other users to use and share. Take care not to share personal data unless you intend for that data to become public. Please also be considerate and respectful of others while using the community to share your opinions. We reserve the right, but do not have the obligation, to review and monitor such posting or any other content on our Services, and to remove postings or content that may be viewed as inappropriate or offensive to others.

Communications to becauseOne:
You may contact us via email, phone or by other means (for example, with questions about our Services, for customer support, or to let us know your ideas for new products or modifications to existing products). You may also choose to respond to surveys that we send out, or queries about your Room, account, etc. When you do so, we collect the information you choose to provide us, such as your contact details, any images you choose to upload and the contents and nature of your message.

We would ask that you take care not to send financial information or other sensitive personal data to us through our services, unless we ask you specifically for that data as part of providing our Service to you. When you provide such information to us directly, you consent to the processing of this data by becauseOne and/or our service providers. We collect the information listed in this section for the purposes described below in the sections “Our Use of Information Collected” and “Our Disclosure of Information Collected Through the Services.” While you are under no obligation to provide us with such information, should you choose to withhold such information, we may not be able to provide you with some or all of the Services.

B. Information That is Passively or Automatically Collected

Location Information:
When you use the Services to open a Room, the Services request that you provide your zip code, city or town, and state. Please keep in mind that other users of the Services can view/search by your zip code, in connection with the Room.

OUR USE OF INFORMATION COLLECTED

becauseOne uses the information collected from the Services in a manner that is consistent with this Notice. We use the information that you provide (or otherwise permit the Services to access) for the following purposes:

A. Communicating With You

We use the information we collect to contact you for administrative purposes (e.g., to provide services and information that you request or to respond to comments and questions). For instance, if you contact us by email, we will use the information you provide to answer your question or resolve your problem.

We also use the information we collect to send you communications relating to the Services, such as updates and communications of services we believe will be of interest to you. For example, we can send periodic emails to registered users of the Services relating to their recent interactions with the Services, such as donating to a Room.

Users agree to subscribe and receive marketing emails. User information is collected by a 3 ^rd party (ie: Drip or other marketing website). Information will be used for marketing pieces as they relate to your information. Users can unsubscribe at any time by using the “unsubscribe” link included in the correspondence.

B. Providing the Services

We use the information we collect to operate, maintain, and provide our Services such as enabling access to the Platform, customer support or to complete transactions.

C. Security and Fraud Prevention

We use the information we collect to secure our Services and to verify identity, prevent fraud, and to continually improve these aspects of our Services.

D. Analytics, Research and Product Development

We use the information we collect to analyze data usage trends and preferences in order to improve the accuracy, effectiveness, security, usability or popularity of our Services. We further use data in connection with our research on our customer demographics, interests and behavior.

We may collect analytics data, or use third-party analytics tools such as Google Analytics, to help us measure traffic and usage trends for the Service and to understand more about the demographics of our users. E. Legal

We use information we collect to defend our legal rights, comply with state, local, federal or international laws, and to enforce our Terms of Service and this Notice.

F. Cookies

As is true of most web sites, we gather certain information automatically and store it in log files. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. To collect this information, when you visit our Site, a "cookie" may be set on your computer. Cookies contain a small amount of information that allows our web servers to recognize you whenever you visit. We store information that we collect through cookies, log files and/or clear gifs to create "settings" regarding your preferences.

We, and third parties (ie: Drip, Google Analytics, etc), use this information to enhance and personalize the user experience, to monitor and improve our websites and services, and for other internal purposes. We use cookie information to analyze trends, administer the website, track users' movements, send targeted marketing pieces and gather demographic information for aggregate use. We also may use cookies to enable our servers to recognize your web browser and tell us how and when you visit the Site and otherwise use the Services through the Internet.

Many browsers have an option for disabling cookies, which may prevent your browser from accepting new cookies or enable selective use of cookies. A user who does not accept cookies from our Site may not be able to access certain areas of the Site.

Release of Information

A. Third Parties that Partner With Us

Nonprofits agree to share organization information (including but not limited to organization phone number, address, EIN, tax documentation, etc) with a payment processor for verification. becauseOne can only see limited information provided by the payment processer. This information includes: business name, registered email, payments made to the room, and verification of attached bank account. By registering as a user, completing the Room application and opening your room, you agree to allow becauseOne to use this information for customer service purposes and internal data collection.

When you link to or interact directly with third-party companies (ie: payment processors), their use of your personal information and your use of their features are governed by the privacy notices of those companies. We do not sell, trade, or rent your Personally Identifiable Information or your Secure Information (other than in a transaction involving the sale of substantially all of becauseOne, LLC).

B. Legal Requirements:

becauseOne can access, disclose, transfer and preserve your information when we have a good faith belief that doing so is necessary to: (i) comply with the law including with subpoenas, search warrants, court orders, and other legal process; and respond to inquiries or requests from government, regulatory, law enforcement, public authorities, or content protection organizations; (ii) protect and defend the legal rights, privacy, safety or property of becauseOne, its affiliates, subsidiaries, employees, agents, contractors, or its users; (iii) permit us to pursue available remedies, commence, participate in, or defend litigation, or limit the damages we may sustain; or (iv) enforce this Notice or any applicable Terms of Service.

C. Organizations you give to:

We share your information with organizations who opened a Room. For example, as a Gifter gives through a Room:

- The Gifter will see: the donated item, the Room it was given to, the date, quantity, and $ amount.

- The Nonprofit will see: the donated item, gifter's name, date, quantity and $ amount. The Gifter's email will also be shared with the nonprofit so they can issue a formal gift receipt.

- Should you choose to give anonymously, your name will not appear to the public, but the nonprofit will still receive your email address to issue a gift receipt for your records.

For example, if an individual starts a fundraiser for a Charity and you donate to that fundraiser, then if the information is requested, (i) the Charity can receive information about both the organizer, if not the same, and donors, and (ii) organizer can receive donor information. In the same scenario, the beneficiary may communicate with you about your donation and/or may rely on your information in order to comply with its legal and auditing requirements.

Security of Information

You can be assured that your information is secure, consistent with current industry standards when you use the becauseOne Platform. Your information is protected in several ways. Access by you to your information is available through a password. This password is securely hashed, and not stored in plaintext. We recommend that you do not divulge your password to anyone, nor reuse your password across different sites on the internet. In addition, your information resides on a secure server that only selected becauseOne, LLC personnel and contractors have access to via password. We encrypt your information and thereby prevent unauthorized parties from viewing such information when it is transmitted to us or to you.

For security purposes, we encourage all of our users to enable two factor authentication.

In order to most efficiently serve you, credit card transactions and ACH transactions are handled by established third party financial institutions. They receive the information needed to verify and authorize your credit card or other payment information.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your information, you acknowledge that: (a) there are security and privacy limitations of the Internet which are beyond our control; (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this site cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party.

Your access to and use of the Services is subject to becauseOne’s Terms of Use and such other terms, which may be made available to you in connection with your use of the Services.
